FL Court of Appeals Rules TTD Benefits Cap Unconstitutional

Below is the FL District Court of Appeals ruling regarding the unconstitutional ruling of the TTD benefits cap in Florida of 104 weeks.  The ruling rolls back the maximum to 260 weeks as outlined by the 1992 benefit law.  In Short, the ruling was upheld by 5-judge panel of the Appeals Court, but the court also decided that it will re-hear the case with all 15 judges after April 24, 2013.

It will be interesting and important to see if the full Court follows the trend of a more claimant oriented approach.
